A sub-tenant must also be mindful that any right it enjoys is contingent on the main lease: if the head lease ends (by time or by termination), the sublease also ends. The sub-tenant generally has no right to stay on if the main lease is gone (unlike some jurisdictions where sub-tenants might get a statutory opportunity to attorn to the owner, Quebec has no such statutory scheme for commercial leases). Therefore, the sub-tenant’s position is somewhat precarious and heavily dependent on the original tenant’s and landlord’s actions.
